You probably know the famous device of PUMA, the bounding feline, many times counterfeited with or without imagination.
The Portuguese company Trendiamo tempted it with the filing of a European trademark representing a bounding pig, all in black, in relation with goods of class 25, i.e clothing and shoes.
The company PUMA bounding to defend its rights, filed an opposition before the EUIPO and obtained the rejection of this application on the ground of its prior rights. As the goods were identical, the Office also considered that the signs were too close to coexist, also taking into account the notoriousness of the bounding puma.
